Dragonfly Energy Corp. (“Dragonfly Energy,” “we,” “us,” or “our”) operates this store and website under its brands Battle Born® and Battle Born Batteries® (collectively, the “Battle Born brands”). Dragonfly Energy also operates the Wakespeed® brand, which maintains its own separate privacy policy. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction through this website and its related services (the “Services”), or when you otherwise communicate with us. 

This website is powered by Shopify. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information. 

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described herein.

  • Calculator Results: If you use our Battery Bank Calculator, we require your email address to send you your calculator results and provide the requested calculator functionality. You may also choose to provide your name and phone number. We do not use the email address submitted through the Battery Calculator for promotional email marketing unless you separately opt in to receive marketing communications. 
  • Security and Fraud Prevention: We use your personal information to authenticate your account, provide a secure shopping and payment experience, detect, investigate, or take action against potentially fraudulent, illegal, unsafe, or malicious activity, and protect public safety. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else. 
  • Communicating with You: We use your personal information to provide customer support, respond to your inquiries, and maintain our business relationship with you. Please note that inbound calls to our customer support team may be recorded for quality assurance and training purposes. By calling us, you consent to this recording. 
  • Legal and Compliance Reasons: We use your personal information to comply with applicable law, respond to valid legal process including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.   • Corporate affiliates: including other entities within the Dragonfly Energy Corp. corporate group.

5. Our Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit through the Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside. 

We use certain Shopify enhanced features that incorporate data obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store. In these circumstances, Shopify is responsible for the processing of your personal information, including responding to requests to exercise your rights over its use.

6. Cookies and Tracking Technologies

We and our third-party partners use cookies, pixels, tags, and similar tracking technologies on our website to collect information about your device, browsing behavior, and interactions with our Services. When you first visit our website, you will be presented with a cookie consent banner that allows you to manage your preferences. 

We use the following categories of tracking technologies: 

Analytics 

  • Google Analytics 4 (GA4): Used to analyze website traffic, user behavior, and site performance. GA4 may also be used to build advertising audiences. 
  • Hotjar: Used for session recording, heatmaps, and behavioral analytics. Hotjar may capture mouse movements, clicks, scroll behavior, and page interactions to help us understand how users engage with our website. Hotjar is configured to mask sensitive fields and does not capture payment information. 

Advertising 

We use advertising pixels and tags to track conversions, measure ad performance, and serve you relevant advertisements on other platforms. These tools may share data with advertising partners for the purpose of targeted advertising, which may constitute a “sale” or “sharing” of personal information under applicable privacy laws. You have the right to opt out of these uses (see Section 9). 

  • Google Ads: Used for conversion tracking and remarketing campaigns. 
  • Bing Ads (Microsoft Advertising): Used for conversion tracking and remarketing campaigns. 
  • Meta (Facebook) Ads via Stape: We use Stape as a server-side tag manager to route data to Meta’s advertising platform. This enables conversion tracking and audience targeting for Facebook and Instagram advertising. 

Business Visitor Identification 

  • ZoomInfo WebSights: We use ZoomInfo WebSights, which identifies the company or organization associated with your IP address when you visit our website. This tool may collect firmographic data (such as company name, industry, and location) linked to your device’s network, even if you have not filled out a form or created an account. This information is used for business development and to better understand our website visitors. 

Managing Cookie Preferences 

You can manage your cookie and tracking preferences at any time using the cookie consent banner on our website. You may also set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. Please note that disabling certain cookies may affect the functionality of parts of our website. Dragonfly Energy Corp. operates mobile applications under the Battle Born and Wakespeed brands. The collection and use of personal information through these apps is governed by their respective dedicated privacy policies, which can be found within each application and on their respective app store listings. This Privacy Policy does not apply to information collected through those applications.

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline your request as permitted by law.

If you opt out, we may still send you non-promotional emails, such as those about your account, orders, customer support inquiries, or Battery Calculator results.

To submit a request, please contact us using the information in Section 16 We may need to verify your identity before processing your request. You may also designate an authorized agent to make requests on your behalf.  In order to verify your authorized agent, you must provide the authorized agent with signed, written permission to make such requests on your behalf or power of attorney. If permitted under applicable law, we may also follow up with you to verify your identity before processing the authorized agent’s request. 

If we deny your request to exercise any of the rights above, you may appeal that denial by contacting us using the information in Section 16. 

Nevada residents: We do not currently sell personal information in a way that triggers the Nevada Revised Statutes Chapter 603A opt-out requirements, but you may submit a request to opt out of any potential future sales under Nevada law to info@dragonflyenergy.com.

Sensitive Personal Information The CCPA allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes Please note that we do not use or disclose sensitive personal information other than for purposes for which you cannot opt out under the CCPA.

“Sale” of Personal Information.  We do not sell personal information in the traditional sense, but we may disclose certain identifiers (like IP address and email address), internet or other electronic network activity information (like information regarding an individual’s browsing interactions on the Site), and inferences to certain analytics, advertising, and marketing providers in ways that may be considered “sales” under the CCPA.  See Section 9 for information about how to opt out of these disclosures.

“Sharing” of Personal Information.  Under the CCPA, “sharing” is defined as the targeting of advertising to a consumer based on that consumer’s personal information obtained from the consumer’s activity across websites. We “share” information for these purposes to provide more relevant and tailored advertising to you regarding the Services. We do not knowingly “sell” or “share” the personal information of children under 16.
